1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of timepassgames.net (the "Site"), operated by Timepass Games LLC ("Timepass Games," "we," "our," or "us"). By using the Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products or create an account. By using the Site, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Accounts

When you create an account, you are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Orders, Pricing, and Payment

• All prices are listed in US Dollars and are subject to change without notice
• We reserve the right to refuse or cancel any order at our discretion
• Payment is processed securely through Stripe; we do not store full card details
• You authorize us to charge your payment method for the total order amount including taxes and shipping
• In the event of a pricing error, we reserve the right to cancel the order and issue a full refund

5. Shipping and Delivery

We will make reasonable efforts to ship orders within the timeframe stated at checkout, but delivery times are estimates and not guaranteed. Risk of loss and title for items pass to you upon our delivery to the carrier. We are not liable for delays caused by carriers, customs, or events outside our control.

6. Returns and Refunds

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

7. User Content

By submitting reviews, blog posts, comments, or other content ("User Content") to the Site, you grant Timepass Games a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, and display that content in connection with operating and promoting the Site. You represent that you own or have the right to submit the content, and that it does not violate the rights of any third party.

We reserve the right to remove any User Content that violates these Terms, our community standards, or applicable law.

8. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Site or accounts
• Interfere with or disrupt the Site or its servers
• Use bots, scrapers, or other automated tools without our written permission
• Submit false, misleading, or fraudulent reviews or content
• Infringe the intellectual property rights of Timepass Games or any third party

9. Intellectual Property

All content on the Site — including game designs, artwork, text, logos, graphics, and the Timepass Games name — is the property of Timepass Games LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

10. Vendor and Promoter Programs

If you participate in our vendor or promoter (affiliate) programs, additional terms apply as outlined in your program agreement. Commissions, payouts, and content approval are subject to those program terms and our discretion.

11. Disclaimers

The Site and products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, Timepass Games LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or products. Our total liability for any claim arising out of or relating to these Terms will not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Timepass Games LLC and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Site.

14. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by JAMS or the American Arbitration Association under their applicable consumer rules. The arbitration will take place in California, and the arbitrator's decision will be final and binding.

You waive the right to participate in a class action or class-wide arbitration. Either party may bring an individual claim in small claims court if eligible. This section does not prevent either party from seeking injunctive relief in court for intellectual property violations.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Subject to the arbitration provision above, you consent to the exclusive jurisdiction of the state and federal courts located in California.

16. Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
